A hearing was held in the Delhi High Court on Tuesday regarding police action against students and protesters during the “Sansad Chalo” march. During the hearing, senior advocate Gopal Shankaranarayan claimed that in the viral video, Delhi Police ADCP Sandeep Lamba is seen slapping a female protestor. Without making any comment on this matter, the court has issued a notice to Delhi Police and the Central Government and has ordered to preserve all CCTV footage and other records related to the incident. Accused of slapping woman, video shown in court
During the hearing of PILs filed in Delhi High Court, senior advocate Gopal Shankaranarayan said that his team has examined about 130 videos related to the incident. He claimed in the court that many people were seen using force on the protesters without police uniform and without identity badges. Citing a video, he alleged that Additional Deputy Commissioner of Police, North East District of Delhi Police i.e. ADCP Sandeep Lamba is seen slapping a female protestor, while she was not doing anything. He told the court that action should also be taken against such officers wearing uniform.

What did Delhi High Court say
The division bench of Chief Justice Devendra Kumar Upadhyay and Justice Tejas Karia currently refused to comment on the veracity of the allegations. However, the court issued notice to Delhi Police and the Central Government and directed them to file their reply within four weeks. The court also said that all the necessary records, CCTV footage and videography related to the incidents mentioned in the petitions should be kept safe as per the SOP of Delhi Police and Central Government. The next hearing of the case will be on September 11.
Petitioners made serious allegations against the police
Senior advocate N., appearing for the petitioners. Hariharan, Gopal Shankaranarayan and Vikas Singh told the court that the protest that started from Jantar Mantar was peaceful and people were exercising their rights under Articles 19 and 21 of the Constitution. His allegation was that the police used excessive force. It was also claimed in the court that sticks, tear gas, pellets and electric batons were used, due to which more than 90 protesters were injured. The petitioners also demanded an independent investigation into the entire matter and registration of FIR against the concerned policemen.
Delhi Police called the allegations misleading
Additional Solicitor General S., appearing for Delhi Police and Central Government. V. Raju opposed the petitions. He said that the entire matter is based on social media videos, the authenticity of which has not been proven yet. According to him, the protest had turned violent and several videos showed injuries to policemen and vandalism of government vehicles. He told the court that the petitioners have hidden many facts and if a crime has been committed against a person, there are different remedies available in the law. Raju also said that if any cognizable offense is made out and the police gets information about it, then action will be taken as per law.
The court also mentioned the remedy under public law.
During the hearing, the High Court mentioned the Anita Thakur vs. Jammu and Kashmir decision of the Supreme Court. The court said that relief can also be sought under public law on allegations of violation of fundamental rights during police action. The court made it clear that at present it is not giving any opinion on the veracity of the allegations of any party. At present, orders have only been given to keep the records safe and seek answers from the concerned parties, so that all the necessary evidence is available during the hearing.
Who is ADCP Sandeep Lamba?
Sandeep Lamba is posted as Additional Deputy Commissioner of Police of North East District in Delhi Police. He is an officer of DANIPS cadre. His name came into controversy after the video went viral during the “Sansad Chalo” march. The petitioners allege that he slapped a woman protestor, while Lamba, instead of directly reacting to these allegations, told the media that during the protest the crowd was trying to break the barricade and stone pelting took place. According to him, a stone hit his knee, causing injury and his uniform also got torn in the scuffle.

Many FIRs were registered after the demonstration
According to Delhi Police, at least nine FIRs have been registered on charges of violence, stone pelting and vandalism during the “Sansad Chalo” march. These cases have been registered in many police stations including Parliament Street, Barakhamba Road and Connaught Place. In these, sections like attack on a government employee, damage to government and private property, rioting and attempt to murder an RAF soldier have been imposed. Now the next hearing of this entire matter of Delhi High Court will be on September 11, where the police and the central government will file their reply.
