
Supreme Court on Collegium System: The Supreme Court has given a big statement regarding the process of selection of High Court and Supreme Court judges. The top court said that the selection process (decisions of the collegium) is outside the right to information i.e. RTI and judicial review. The court said that even judicial review of the selection process of judges cannot be done. Actually, this statement of the Supreme Court came during the hearing of the petition in which the question of lack of transparency in the collegium system was raised.
The bench of Justice BV Nagarathna said that the decision of the collegium is based on its own understanding and satisfaction. Neither the High Court nor the Supreme Court can find any flaw in the recommendation of any candidate by hearing petitions or issuing instructions. The bench said that we do not want to create such a situation which would create new difficulties.
We will not interfere in the decisions of the collegium – SC
The bench of Justice BV Nagarathna said that we will not interfere in the decisions of the collegium. The bench also pointed out that hundreds of candidates are called for talks before selecting a few candidates and recommending their names.
What is collegium system?
Collegium system is a type of system. Through this, appointment, promotion and transfer of judges are done in the Supreme Court and High Courts of various states. The most special thing about this system is that the judges are appointed by the judges themselves. The Supreme Court Collegium consists of the Chief Justice of India and the four most senior judges of the Supreme Court. At the same time, the High Court Collegium includes the Chief Justice of the concerned High Court and the two most senior judges of the same court.
