Relief to Ravi Kishan from Delhi High Court, order to remove targeting AI deepfake content from social media

Actor Ravi Kishan: Delhi High Court on Thursday gave relief to actor Ravi Kishan and directed several online intermediaries including Google, YouTube and X to remove deepfake videos, AI-generated content and cloned-voice advertisements, which violate his personality rights. During the hearing, Justice Jyoti Singh drew a line through artificial intelligence between content that used Ravi Kishan’s personality without permission and content that was merely defamatory. An order has been given to remove the content immediately.

Actually, BJP MP from Gorakhpur Ravi Kishan Had filed an application in Delhi High Court demanding a ban against more than 30 people. These people also include unknown people. These people are accused of using their images, voices and likeness photos on social media platforms and websites without permission by using artificial intelligence.

Personality rights and defamation

During the hearing, the lawyer appearing for Google LLC tried to differentiate between the two categories of content alleged against his client. He said that one category included allegations of defamation rather than violation of personality rights. The lawyer said that the allegations he (Ravi Kishan) is making are defamation. A defamation claim and a personality rights claim are completely different reasons and not compatible with each other.

Dialogue delivery and use of voice

A separate complaint was related to a YouTube channel, where the actor said that the channel had used his signature dialogue delivery and voice for an FM radio advertisement without permission. The Court directed that this content also be removed, noting that the uploader, who is already a party, would be primarily liable and intermediate liability would arise only if the uploader failed to comply within the timeline set by the Court.

The court has directed to remove the content that violates the personality rights of the actor and to comply within 1 week of receiving the order. Whereas the question of defamatory content, including YouTube posts uploaded by one of the defendants, has been kept out of the scope of the current removal instructions.
