
Gujarat High Court has given a big decision in a case related to court marriage. The court said that if traditional rituals like seven rounds were not performed in a Hindu marriage, then it cannot be considered a valid Hindu marriage on the basis of registration alone. The High Court said in its judgment that the traditional rituals of Hindu marriage purify and transform the spiritual life of a person. These rituals are very important.
Actually, this decision has come by canceling an order of the Family Court in November last year. The Family Court had rejected the appeal of Kaushal Sonar, who lives in Britain. He had demanded to declare his alleged marriage invalid. Justice Ilesh Vora and Justice R. T. Vachani’s bench clearly said that important rituals like Saptapadi i.e. seven rounds are the basic basis of Hindu marriage.
Marriage is not valid just by registration
The court said that without these, marriage is not valid merely by registration. Kaushal Sonar told the court that he came to know about this alleged marriage when the defendant contacted his parents and gave a marriage certificate claiming that she was his wife. Sonar said that he never married this woman, did not perform any Hindu rituals nor did he ever live with her like husband and wife.
The court cited section 7
The High Court found that the woman herself had clearly admitted in the family court that no ritual or ceremony took place between them and there was never a husband-wife relationship between them. Despite this, the Family Court rejected Kaushal Sonar’s petition, which was wrong. The court cited Section 7 of the Hindu Marriage Act.
It says that traditional rituals and ceremonies are necessary to make a Hindu marriage complete and valid. The court said that since no ritual or ceremony was organized in this case, the basic conditions of Hindu marriage were not fulfilled. Therefore this marriage is not valid.
