
The Rajasthan High Court on Friday directed the authorities not to take any strict action in connection with the FIR lodged on May 28 at Padu Kalan police station in Nagaur district against Rashtriya Loktantrik Party leader Hanuman Beniwal. Justice Farzand Ali has given this interim order while hearing the criminal miscellaneous petition of Beniwal, in which the FIR registered under the provisions of Indian Justice Code (BNS), 2023 and Section 8B of the National Highways Act, 1956 was challenged. The court has now fixed the next hearing of this case after three weeks.
Actually, Beniwal is a Lok Sabha MP from Nagaur, Rajasthan and the President of Rashtriya Loktantrik Party (RLP). The complaint was filed against Beniwal and 13 others in connection with a political meeting and subsequent procession against the sand mafia at Riyan Badi in Nagaur on January 6, in which it is alleged that Beniwal had participated along with several others. However, in its order, the court said that this matter needs to be investigated on the basis of its inherent powers under Section 528 of the Indian Civil Security Code (BNSS), 2023.
These issues need to be considered in the case
The court said that the issues that need to be considered include whether the allegations, even if prima facie considered true, satisfy the essential elements of the offence, whether there are sufficient facts to impose individual criminal liability on Beniwal and whether continuing with the proceedings would be an abuse of the process of law?
Hearing postponed for 3 weeks
The court postponed the hearing of the case for three weeks after Additional Advocate General Deepak Chaudhary sought time to file the reply on behalf of the defendants. Till the next hearing, the court ordered that no strict action should be taken against Beniwal in connection with the FIR.
