
The Supreme Court has given strict instructions regarding delay in pronouncing all High Court decisions. The SC, using its powers under Article 142 of the Constitution, said that all cases should be disposed of as soon as possible. A bench headed by CJI Surya Kant directed all HCs to deliver the pending verdict within three months. The Supreme Court ordered that the bail order be pronounced on the same day or the next day if the verdict is given.
The Supreme Court of the country also directed the lower courts to immediately inform the regular bail orders. He said that undertrials granted bail should be released on the same day subject to formalities. The Supreme Court said that all judgments should be uploaded on HC websites within 24 hours of being pronounced. The date of pronouncement of the main part of the judgment will be considered as the date of pronouncement.
‘It is important to hear the decision on time’
The Supreme Court said that HCs are primary institutions, where thousands of people come to get justice and it is necessary to deliver judgments on time. The Supreme Court made it clear that these instructions are not for the purpose of defaming any judge or institution. The order was given by the Supreme Court in the matter related to delay in the decisions of Jharkhand High Court. If for some reason the decision is not given within three months, the party will have the option to apply.
