
While granting bail to pregnant Nida Khan, accused in the conversion case related to Tata Consultancy Services (TCS) in Nashik, Maharashtra, the local court said that the pain of giving birth to a child in jail is unbearable for any woman. During its decision the court also mentioned the birth of Lord Krishna.
Special Session Judge (Nashik Road) K. Yes. Joshi said in his order that the investigation so far has prima facie revealed that Nida Khan with the help of co-accused allegedly tried to ‘ideologically influence the victim’. They also conspired to change his thinking and religion.
Nida Khan 5 months pregnant
Referring to the investigation into the case related to sexual harassment and alleged conversion, the court said that the accused also tried to make the victim believe that ‘there are many objectionable stories in Hindu religion.’ Nida, who was arrested two months ago, was granted bail by the court on July 6 itself. But a detailed order in this regard was made available yesterday on Thursday.
The judge said in his order that the alleged role of Nida Khan is clearly mentioned in the FIR. However, the court took into consideration the defense’s argument and accepted Nida’s bail plea that she was 5 months pregnant.
Giving birth in jail is painful: Court
The court said, “Like the birth of Lord Krishna, the pain of giving birth to a child in jail and the social stigma associated with it is unbearable for any woman.” He further said that to avoid such an extremely painful situation and keeping in mind the birth of the child and its overall welfare, it would be appropriate to exercise judicial discretion in favor of the applicant-accused.
Judge Joshi said that along with the applicant being pregnant, the investigation of the case has been completed and the charge sheet has also been filed. In such a situation, there is no justification for keeping him in judicial custody. The court granted bail to Nida on a personal bond of Rs 75,000 and one competent surety of the same amount.
After the case related to religious conversion in the company came to light, the Special Investigation Team (SIT) of Nashik Police is investigating a total of 9 cases related to alleged exploitation of women employees in the TCS unit, attempts at forced religious conversion, hurting religious sentiments, molestation and mental harassment.
Accusation of insulting gods and goddesses
Unlike other accused, chargesheet has been filed against Nida Khan in only one case registered at Deolali Camp police station. Whereas a total of 9 FIRs were registered against 7 other accused in this case between March 26 and April 3.
Nida Khan is accused of giving burqa and religious books to her colleagues. Besides, religious apps were also installed in his mobile phone. He is accused of insulting the gods and goddesses of Hindu religion. It has been said in the police FIR that Nida had also said many abusive words about Lord Krishna.
The case is registered at Devlali Camp police station, under section 69 (sexual intercourse by means of deceit), section 65 (sexual harassment) and section 299 (hurting religious sentiments) of the Indian Code of Justice (BNS). Also, since the victim is a Dalit, relevant sections of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act have also been imposed against the accused.
