
Is raising voice against the government a crime or a part of the democratic system? Can a person be thrown out of his area for raising his voice against the government? In one such case, the Bombay High Court said that a person cannot be thrown out of his district merely because of protesting against the government or raising slogans. Actually, a local leader (Syed Ahmed Chaudhary) was protesting against the government and Union Home Minister Amit Shah.
The police had expelled him from the district for 1 year. In this case the court canceled this order. The court said, raising slogans and protesting peacefully is the right of every citizen. No one can be punished just for this reason.
‘Citizens are being made slaves of the government’
Justice Madhav J. while hearing the petition of 49 year old Syed Ahmed Abdul Wahid Chaudhary. Jamdar’s single-judge bench asked the police whether citizens were being made “slaves of the government” by registering cases for opposing government decisions and why they could not protest. Sayeed had told that he was the General Secretary of the Socialist Democratic Party of India (SDPI) and he was thrown out of the city for a year.
Justice Jamdar wanted to know why the Mumbai Police issued an externment order on the basis of an FIR related to the petitioner’s earlier protests in which slogans like ‘Down with BJP government’ and ‘Down with Amit Shah’ were raised. Referring to the recent exam paper leak case and the plea of the petitioner, he asked why citizens cannot protest or raise slogans?
Justice Jamdar said, “It is the right of citizens to protest. The petitioner has simply raised slogans like ‘Down with BJP government’, ‘Down with Amit Shah’. Why can’t citizens raise such slogans and why orders to throw them out of the city for such slogans?”
Court warned the police
Warning the police, he said that they are servants of the public and not of senior government officials. Petitioner Chaudhary had challenged the deportation order of the Deputy Commissioner of Police dated December 3, 2025. He was exiled from the country for a year.
