Neither passport, nor Aadhaar… which documents will be the proof that you are a citizen of India?

Almost every Indian has documents like Aadhar Card, PAN Card, Voter ID and Passport. Generally people also consider them as proof of their identity and citizenship. But do these documents actually prove that you are a citizen of India? Actually, all these are important documents, but they are not considered as the final proof of Indian citizenship. The Indian Constitution and citizenship law answer this question differently. Citizenship in India is not determined by any one identity card, but is determined on the basis of the rules laid down in the Constitution and the Citizenship Act, 1955. Indian citizenship can be acquired through legal processes such as birth, descent, registration, naturalization or accession of a new territory to India. In such a situation, the question is which documents are valid to prove Indian citizenship and what does the law say about this. We will understand this in detail in this news.

What is citizenship after all?

Citizenship is a legal relationship between a person and his country. This relationship gives rights and facilities to a person under the Constitution. That is, the right to vote, government benefits, government job opportunities, legal protection and the right to be associated with the country comes only through citizenship. For this reason, every country decides who will be considered its citizen and who will not. In India too, the rules of citizenship have been decided under the Constitution and Citizenship Act.

What does the Constitution say?

Provisions related to citizenship are given in Part 2 (Articles 5 to 11) of the Indian Constitution. According to the Constitution, those people living in India at the time the Constitution came into force on January 26, 1950, were considered Indian citizens who were born in India or one of whose parents was born in India. Apart from this, special provisions of citizenship were also made for some people who came to India from Pakistan during partition and those who returned to India later.

What is Citizenship Act 1955?

After the implementation of the Constitution, the Citizenship Act 1955 was made to further clarify the rules related to citizenship. In this law, it was told under what circumstances Indian citizenship can be obtained and under what circumstances it can be lost. According to the law, citizenship can be given by birth, descent, registration, naturalization and in case of inclusion of any new territory in India. Even today, this law is the basis of most of the cases related to Indian citizenship.

How is citizenship obtained on the basis of birth?

Section 3 of the Citizenship Act talks about granting citizenship on the basis of birth. Under this, different rules have been made for people born in different time periods. A person born in India between 26 January 1950 and 1 July 1987 is generally considered an Indian citizen. In later years, conditions like citizenship of parents and illegal migration were also added. That is, being born in India alone is not sufficient in every case, but the date of birth and status of parents can also be important.

People born abroad can also become Indian citizens

Section 4 of the Citizenship Act provides for citizenship on the basis of descent. Under this, a person born outside India can also claim Indian citizenship, if either of his parents is an Indian citizen. It is also necessary for children born abroad after December 3, 2004 to register with the Indian Embassy within the stipulated time. The purpose of this arrangement is to give citizenship rights to the children of Indian families living abroad.

Path to registration and naturalization

Some foreign citizens living in India can also acquire Indian citizenship. There is a provision for registration under Section 5 of the Citizenship Act and naturalization under Section 6. For this, the applicant has to fulfill the conditions prescribed in the law and apply. If the application is approved, the person concerned is granted Indian citizenship. Official citizenship certificate is also issued to such people by the government.

Then what is the real proof of citizenship?

There is no single universal document to prove citizenship in India. If a person’s citizenship is based on birth, then his birth certificate can be considered an important document, because the place of birth is recorded in it. People who become citizens through registration or naturalization get a certificate issued by the Government of India. This document works as proof of citizenship for them.

So what are Aadhaar, PAN, Voter ID and Passport?

Aadhar card is a useful document for identification and government schemes. PAN card is issued for tax related purposes. Voter ID is a document related to the right to vote. Ration card helps in government schemes and residence related identification. According to officials of the Ministry of External Affairs, passport is a travel document and not a citizenship certificate. These documents are used for identification, address or services, but are not legally considered final proof of citizenship.

Does citizenship get lost due to lack of documents?

The most important thing is that just because a person does not have Aadhaar, PAN, Voter ID, Ration Card or passport, his citizenship does not automatically get lost. Citizenship in India is decided by the Constitution and law, not by any single card or document. For this reason, questions related to citizenship are decided by courts and government agencies based on the facts of each case, birth records and legal documents.

Documents useful for proof of citizenship

  • Birth Certificate – If citizenship is claimed on the basis of birth.
  • Citizenship Certificate – Issued to those who acquire citizenship by registration (Section 5) or naturalization (Section 6).
  • Citizenship order/certificate issued by the Government of India.
  • Registration record at the Indian Embassy (in cases of citizenship by descent).
  • Gazette Notification – If citizenship has been given on the accession of any area to India.
