Keeping in mind the balance of development and environment, the Supreme Court gave an important decision on Wednesday. The top court said that in future, environmental clearance will have to be obtained before starting any new project. Approval will not be given after the work starts. The court said that this decision will be applicable only from now onwards. Projects that have already received environmental clearance will not be affected by this.
Along with this, the court canceled the government order of 2021, in which the Central Government was given the right to give environmental clearance to the projects after the work is done or after the completion of the project.
What was the government order of 2021?
Under the 2021 order of the Central Government, companies could start their projects even without environmental clearance and later get approval from the government. The Supreme Court has completely abolished this 2021 order of the government. The court said that this system of apologizing after causing harm to the environment is wrong. From now on, no company will be able to start its work without first taking permission.
The companies or projects which have already received approval under this old rule are safe and their work will continue. The court said that this decision will not have any effect on them. The bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice Vipul Pancholi gave this decision. The Supreme Court had reserved the decision in this matter for six days of hearing on April 1, 2026.
