
Allahabad High Court granted bail to the accused in a rape and murder case due to lack of scientific evidence. During this, the court expressed deep concern over the forensic investigation system of Uttar Pradesh. The court said that it is forced to grant bail to the accused with a heavy heart, as scientific evidence has failed to link the accused to the crime. The court expressed strong displeasure over the poor condition of the forensic lab of the state government.
The bench of Justice Arun Kumar Singh Deshwal, while accepting the bail plea of accused Manoj, said that the report of Forensic Science Lab (FSL) could not prove that the DNA profile found in the vaginal smear of the deceased was that of the applicant. The reason was that the DNA profile was incomplete. The court said that in the FSL report, the DNA obtained from the vaginal smear of the deceased could not be matched with that of the accused. The report said that the DNA profile could not be developed sufficiently, due to which it was not possible to identify its source. The court said that keeping someone in jail without evidence would not be justice.

In its order dated May 21, the court highlighted the fundamental shortcomings of the state’s forensic lab. The court said that this problem arises in most of the cases in the state. The court said, ‘In most of the cases, the FSL report shows that due to the DNA profile being incomplete, the source of the DNA found in the vaginal swab cannot be determined’. The court said that due to incomplete DNA profile, the investigating agencies are not able to reach the criminals.
The court said in clear words that old machines and inadequate infrastructure are the main reasons for this problem. While granting bail to the accused, the court expressed hope that the state government will provide high-end machines to FSL and deploy adequate staff. The bench directed the Registrar (Compliance) of the High Court to send a copy of this order to the Chief Secretary of Uttar Pradesh so that he can bring it to the notice of the Chief Minister.
