
Delhi Chief Minister Rekha Gupta has taken an important and strict decision to stop revenue theft in registration of immovable properties in the capital Delhi, curb land mafias and frauds and ensure security of government revenue. On the instructions of the Chief Minister, strict guidelines have been issued for thorough investigation and scrutiny of property related documents through General Power of Attorney (GPA). Orders have been issued to all sub-registrars to ensure strict compliance with these instructions with immediate effect.
Chief Minister Rekha Gupta said that the government is fully committed to protecting the interests of the citizens of Delhi and securing government revenue. It has been observed that in many cases, the documents are registered only by giving nominal stamp duty in the name of GPA, whereas they also contain provisions like sale of property, handing over of possession and transfer of ownership. This is outright evasion of stamp duty, which will no longer be tolerated at any cost.
Sub-registrar will do a thorough investigation
The Chief Minister said that now all the sub-registrars of Delhi will closely examine each GPA document coming for registration. In the investigation, it will be specifically seen whether there is any mention of any kind of money transaction in the document, whether there is mention of handing over the possession of the property, whether the GPA is irrevocable or whether there is no permanent right given in it to sell, gift, transfer or mortgage the property.
Referral to Collector of Stamps if GPA is outside blood relatives
The Chief Minister said that now the sub-registrar will not be able to directly register the GPA executed in favor of any person other than blood relatives like parents, spouse, son, daughter, brother and sister. It will be mandatory to send all such cases to the concerned Collector of Stamps for adjudication of appropriate stamp duty.
Collector of Stamp will have to give order in 30 days
Chief Minister Rekha Gupta said that the Collector of Stamps will have to pass a reasoned written order with reasons on each such reference within 30 days. It will be clarified in this order whether the concerned document is only a general power of attorney or full stamp duty will be payable on it like conveyance deed (sale deed). In special circumstances, this period can be extended up to a maximum of three months.
Such GPA will not be registered without the order of the Collector of Stamps and payment of appropriate stamp duty. The Chief Minister clarified that if any Sub-Registrar violates these rules and registers such GPA without referring it to the Collector of Stamps, then strict disciplinary action will be taken against the concerned officer.
Strict action will be taken against negligence, online system will be made
The Chief Minister said that to make the entire process more transparent and accountable, a separate register of such cases will be maintained in each sub-registrar office and its monthly report will be sent. Along with this, he has also given instructions to develop an online tracking mechanism to monitor all these cases within a month.
Chief Minister Rekha Gupta said that this step will not only secure the government’s revenue, but will also save common citizens from fraud who unknowingly get trapped in faulty documents. Transparency and honesty is our top priority in Delhi administration.
