Delhi High Court has adopted a strict stance regarding lathi charge on students at Jantar Mantar. The High Court has issued a notice to the Central Government and Delhi Police in this matter. The High Court has ordered Delhi Police to file an affidavit in this case within 4 weeks. Delhi High Court said that the police has been instructed to keep the video and CCTV footage safe. Now the next hearing of this case will be on September 11.
ASG SV Raju said that if a cognizable offense is committed and the police gets information about it, they will take action. The court referred to the decision of the Supreme Court in the Anita Thakur case in which it has been said that remedies can be sought for such mistakes under public law also. The court said that without expressing any opinion on the merits of the case, it is simply asking them to file their reply and preserve the records as per its Standard Operating Procedure (SOP).
While giving the order, the court has directed to file a counter-affidavit (on behalf of Delhi Police and Government of India) within four weeks. Meanwhile, the court directed that all necessary records related to the incident mentioned in the writ petitions – such as CCTV footage and any videography – be preserved as per the SOP issued by the Delhi Police or the Government of India.
