
The Central Government has admitted in the Supreme Court that it will bring back some people deported from Bangladesh to India and then duly investigate their claims of Indian citizenship. During the hearing held on Friday, Solicitor General Tushar Mehta, appearing for the Centre, informed the bench headed by Chief Justice Surya Kant about this decision. The government made it clear that this step is being taken in view of the unique circumstances of the case and it will not be considered a precedent for the future.
A bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice Vipul M. Pancholi is hearing the case. Both the Supreme Court and the Calcutta High Court had already considered the haste adopted in this deportation process as unfair and a violation of the constitutional rights of the citizens.
The court had a clear argument that if a person is claiming to be an Indian citizen and is presenting documents, then he cannot be deported from the country without proper legal process. Earlier in September 2025, the Calcutta High Court had canceled the deportation order of the Delhi Foreigners Regional Registration Office (FRRO) and directed the Center to bring back these people within four weeks, which the Center had challenged in the Supreme Court.
Deported people have been brought back before also
Earlier in December 2025, a 9-month pregnant woman (Sonali Khatoon) and her child related to the same case have already been brought back to India on humanitarian grounds after the intervention of the court. Now the way for the return of her husband and other family members has also been cleared.
The deported people will return to India.
After this statement of the Central Government, now the deported people will be brought back safely to India. After this, the concerned government agencies will check the authenticity of the documents submitted by them like Aadhar Card, PAN Card and Land Records to provide final confirmation of their Indian citizenship claims.
