
Only 3 MPs have reached the meeting of Shiv Sena (UBT) held on Thursday. 6 rebel MPs have distanced themselves from the party’s parliamentary party meeting. After this incident, a split in Uddhav’s party is considered certain. Arvind Sawant, Anil Desai and Raja Waje were present in the meeting called at the party office in Parliament House.
However, according to sources, Sanjay Dina Patil, Sanjay Deshmukh, Nagesh Patil Ashtikar, Omraje Nimbalkar, Bhausaheb Wakchore and Sanjay Jadhav did not attend the meeting. It is claimed that these 6 MPs have formed their own separate parliamentary group and have also submitted the letter related to this to Lok Sabha Speaker Om Birla. UBT will take action against these absent MPs due to violation of Shiv Sena whip.
What are the rules?
According to informed sources, under the Tenth Schedule (anti-defection law) the whip can be validly issued only for the proceedings of the House and not for internal meetings of the party. The reason for this is that the Supreme Court has interpreted the terms “voting” and “abstaining from voting” used in paragraph 2(1)(b) of the Tenth Schedule. The importance of the whip is related to legislative proceedings, not organizational meetings of the party. Whip applies to the proceedings of the House, not to party forums.
Action will be taken against MPs: Arvind Sawant
Arvind Sawant said that action will be taken against those who violate the whip. At the same time, Sanjay Raut said that there is a need to teach the rebels a lesson.
The party leadership had issued a three-line whip and called an emergency meeting of the parliamentary party in New Delhi on Thursday. It was made mandatory for MPs to attend the meeting in person. Raut told reporters in Delhi that the whip has been issued due to the need to discuss important issues. He said that the whip has reached all the MPs. It has been sent to their homes, emailed and also sent on WhatsApp.
Sawant said, action will be taken against those who violate the whip after consultation with the party chief (Uddhav Thackeray). Sawant said that late Shiv Sena founder Bal Thackeray had even suggested beating up MPs and MLAs who switched sides.
