
The Supreme Court has made a big comment on OBC reservation today on Friday. The court said that if the parents are IAS officers then why should they get reservation. If the parents of the students are in good jobs and earning good income, then their children should come out of the reservation. The court made this comment while hearing the petition related to reservation for the creamy layer of backward classes.
During the hearing, Justice Nagarathna said that if both the parents are IAS officers then why should they get the benefit of reservation? He further said, “Educational and economic empowerment leads to social mobility. Therefore, demanding reservation for children will never come out of it. This is an issue on which we also have to pay attention.”
He said, “The parents of the students are in good jobs and earning very good income, yet the children are demanding reservation. Look, they should come out of the reservation. This issue needs a thorough discussion. There should also be some distinction between EWS and the creamy layer.”
Referring to EWS, Justice Nagarathna said that for EWS there is no social backwardness, only economic backwardness. Therefore, the norms in the case of creamy layer should be much more liberal than in EWS. If both are considered equal then there will be no difference.
Justice Nagarathna said that there should be some balance. They may be socially and educationally backward, but when the parents get education up to a certain level by taking advantage of reservation, both of them are IAS officers, both are in government service. They are in very good condition. Social mobility exists. Now there are government orders which are excluding all these people and they are raising questions on this exclusion. This also needs to be kept in mind. However, the bench issued notice on the petition.
