Bihar Bharat Bhushan Tiwari encounter: Petition in Supreme Court, appeal to CJI to take immediate cognizance

A letter petition has been filed in the Supreme Court in the Bharat Bhushan Tiwari encounter case in Bihar. A demand has been made to take immediate cognizance of the CJI in this matter. There has also been a demand for a judicial inquiry into the encounter. Narendra Mishra, a lawyer practicing in the Supreme Court, has sent this letter petition. A demand has been made to direct that a case of murder be registered against the police personnel who carried out the encounter.

Along with this, a reply has been sought from the Bihar government and a request has been made to clarify the situation. It was said in the letter petition that deceased Tiwari had no criminal history, the police action against the family is completely illegal.

Order to conduct investigation by retired judge of High Court

Chief Minister Samrat Chaudhary has ordered the investigation of Bharat Tiwari encounter case by a retired judge of the High Court. He said that the purpose of this investigation is to ensure a fair and transparent investigation into all aspects of the incident. Earlier, the police had registered two separate FIRs related to Bharat Tiwari in the Bhojpur encounter case. The first FIR is related to possessing illegal weapons, obstructing government work, firing on policemen and giving shelter to the accused. Bharat’s father and brother have been made accused in this case. The second FIR itself is related to the police encounter.

Meanwhile, Asha Devi, mother of Bharat Bhushan Tiwari, who was killed in the encounter, has also filed an application to register a case against the policemen involved. He has demanded registration of FIR against Jagdishpur DSP and the then SHO of Shahpur police station.

Appeal for suo motu cognizance from High Court also

At the same time, Patna High Court lawyer Rajneesh Kumar has called this incident a fake encounter. He said, action should be taken against the policemen responsible. He has also demanded the formation of an independent SIT to investigate the case and urged the High Court to take suo motu cognizance.
