Big relief to Hindu man in forced conversion case, court stays criminal proceedings

Supreme Court has given big relief to Hemraj Taylor. A temporary stay has been imposed in the ongoing criminal case against Hemraj Taylor of Madhya Pradesh. The bench of Justice Manoj Mishra and Justice Shri Chandrashekhar gave this order while issuing notice on the petition of Hemraj Taylor. Hemraj Taylor had challenged the order of Madhya Pradesh High Court, in which it had refused to quash the criminal case against him. The Supreme Court has sought a reply from the state in this matter within 6 weeks.

Actually, Hemraj Taylor is accused of forcing a family to convert to Islam. A case was registered against him at Jirapur police station in Rajgarh district. Hemraj had filed a petition in the Madhya Pradesh High Court to get relief in this case, but the High Court refused. In such a situation, he reached the Supreme Court, from where he got temporary relief.

What arguments did Hemraj’s lawyer give?

During the hearing, Hemraj Taylor’s lawyer told the court that the husband of the complainant (woman) had converted to Islam about 8 years ago. FIR has been registered after so many years, hence this matter is very old. Taylor and his entire family are Hindus. He also showed evidence of this in the court.

This case is related to the FIR lodged by the wife of a man who had allegedly converted to Islam under the influence of Taylor. According to the prosecution, after the conversion, the husband allegedly started pressurizing his wife and minor son to convert to Islam, allegedly at the behest of Taylor.

Under which sections is the case registered?

Based on the complaint, the police registered a criminal case against Taylor under Section 3 (Prohibition of Unlawful Religious Conversion) and Section 5 (Punishment for Unlawful Religious Conversion) of the Madhya Pradesh Freedom of Religion Act, 2021, as well as Section 506 (criminal intimidation) and Section 34 (common intention) of the Indian Penal Code (IPC).
