
Lucknow Mayor Sushma Kharkwal has suffered a big shock. The High Court has seized the financial and administrative powers of the Mayor. The court has taken this action due to non-compliance of its order. This decision of the court has come in the matter of not administering oath to Lalit Tiwari even 5 months after declaring him elected to the post of councilor by the session court from Ward No. 73 Faizullaganj. In which the court has said that until the elected councilor is not sworn in, the powers of the mayor will remain suspended.
In this case, the mayor’s side failed to get relief from both the High Court and the Supreme Court. Despite this the order was not followed. Now the bench of Justice Alok Mathur and Justice Qamar Hasan Rizvi has passed this strict order. Senior advocate Gaurav Mehrotra argued the case in the High Court. The court said that disobeying the order cannot be accepted under any circumstances.
What else did the court say?
The court said, local bodies will also have to follow the instructions of the court. According to the information, the Mayor’s side tried to get relief first in the High Court and then in the Supreme Court but could not get relief at both the places. Despite this, the court took a tough stance when the order was not complied with. Senior advocate Gaurav Mehrotra presented his side in the court in the case.
After the order of the High Court, now financial approvals, administrative decisions and many important files in Lucknow Municipal Corporation may be affected. Sushma Kharkwal is the Mayor of Lucknow from May 2023 and is a senior BJP leader.
What is the whole matter?
Lalit Tiwari is the General Secretary of Awadh Bar Association of High Court. On December 19 last year, the Election Tribunal had declared Ward No. 73 councilor Pradeep Shukla’s election void and declared him elected. It was said in the petition on his behalf that the oath was not administered after 5 months of the order. Opposing the petition, the Municipal Corporation argued that the first appeal against the decision is pending. It is not clear what the legal position will be if the appeal is approved.
