
The special court of Mumbai has expressed great displeasure over the slowness of the Mumbai Police in taking the custody of gangster Anmol Bishnoi, accused in the Baba Siddiqui murder case. The court gave clear instructions to the police to ensure the custody of Anmol Bishnoi. The court said that the police did not take any steps to take custody, due to which the court expressed displeasure.
The court said that Anmol Bishnoi is in NIA custody since his extradition last year, yet Mumbai Police did not take necessary steps to interrogate him. The special court directed the Mumbai Police to take custody of Anmol Bishnoi by adopting all necessary measures available under the law and ensure to produce him before the court.
‘This is an unfortunate situation’
The court said in its order, “It is not the job of the court to remind the investigating agency of its statutory duties in a serious murder case. It is an unfortunate situation that the court has to issue directions to follow the procedure laid down in the Indian Civil Defense Code (BNSS) and to ensure the presence of the absconding accused in the court.” Baba Siddiqui’s wife, in a petition filed through her lawyers Pradeep Gharat and Trivankumar Karnani, had alleged that the investigating agency had failed to investigate the alleged larger conspiracy behind the murder.
He also said that despite identifying Anmol Bishnoi as the main conspirator, the agency has deliberately avoided taking his custody. Although the court said that it is not commenting on the intentions of the investigating agency, it is clear from the record that the agency did not use the remedies available under law and its inaction in this case was clearly visible.
What did the police say?
Police told the court that Anmol cannot be physically brought to the Mumbai court, because the Central Government has issued a one-year order under Section 303 of the Indian Civil Security Code (BNSS). According to this, Anmol cannot be taken out of jail for one year. The court said that on this basis alone, the proceedings against the main accused cannot be postponed indefinitely, while the trial is about to begin against 27 other people.
