
The Supreme Court has refused to hear the petition filed by the accused in the case of fraud of Rs 49 crore. In the petition filed, a demand was made to combine and hear the FIRs filed in different states in the case of cheating investors. The bench of CJI Surya Kant, Justice Joymalya Bagchi and Justice Vipul M Pancholi has given this instruction on the petition filed.
This decision has been given on the transfer petition filed by accused Upendra Nath Mishra and Kali Prasad Mishra in the court case. In these FIRs registered, a case of alleged cheating of investors worth Rs 49 crore has been registered.
49 crore investment scam
In fact, the Supreme Court has rejected the petition of the accused to merge the FIRs registered in several states related to the investment scam of Rs 49 crore. The court clearly said that the justice system should give priority to the rights of the victims rather than the convenience of the accused. The bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice Vipul M. Pancholi did not agree with the arguments of senior advocate Aman Lekhi, appearing on behalf of accused Upendra Nath Mishra and Kali Prasad Mishra.
Seeing the court’s tough stance and sharp comments during the hearing, the counsel for the accused withdrew the petition. Several criminal cases are pending against the accused in Odisha, Chhattisgarh, Jharkhand, Gujarat, Maharashtra, Goa and Andhra Pradesh.
What did the Chief Justice say?
The CJI asked that if this is done then what will happen to the rights of the victims of fraud in this situation? He also asked whether it would be right to ask the victims to come to one place from different places for the convenience of those accused of the crime?
