
Calcutta High Court has currently refused to give interim relief to Mamata Banerjee-led TMC in the matter of appointment of Ritabrata Banerjee to the post of Leader of Opposition in the Assembly. The court did not put any stay on the decision of the Assembly Speaker regarding the Leader of Opposition. Ritabrata Banerjee will remain on the post of Leader of Opposition for the time being. The next hearing in this case will be on June 16.
However, during the hearing regarding the election of Leader of Opposition in the Assembly today, the Calcutta High Court asked whether the Speaker of the West Bengal Assembly can recognize the Leader of Opposition without the consent of any political party?

Speaker has given recognition to Ritabrata as LoP

Senior advocate Kalyan Bandopadhyay, appearing on behalf of the petitioner, sought an interim stay on the Speaker’s action. He argued that granting recognition to Ritabrata Banerjee was against the constitutional principles governing political parties and legislative parties under the anti-defection framework.
Kalyan Bandopadhyay told the court that a meeting of the elected MLAs was held on May 6, where Sobhandeb Chattopadhyay was selected as the party’s candidate for the post of Leader of Opposition. He said signatures of supporting MLAs were collected and submitted in favor of Sobhandeb Chattopadhyay, and the Speaker was informed several times about the party’s decision.
Kalyan expressed objection on the Speaker’s decision
He said that despite this, the Speaker allegedly gave recognition to an opposition group supported by 59 MLAs. Referring to Supreme Court judgments related to political party mergers and Maharashtra’s political crisis, Kalyan Bandopadhyay argued that the Tenth Schedule of the Constitution gives priority to the political party rather than just the legislative party.
Let us tell you that after the defeat in the assembly elections, the disunity in TMC continues. After the breakup of the legislative party, now the parliamentary party is also on the verge of breakup and three Rajya Sabha MPs of TMC have also resigned.
