From Singhvi, Bhushan to Shyam Diwan… Army of lawyers came against the government in the Supreme Court on lathi charge.

A bench headed by Chief Justice Surya Kant in the Supreme Court on Tuesday heard the case of police lathi charge during student protests in Delhi’s Jantar Mantar and other parts of the country. During the hearing, an army of senior lawyers descended against the government in the Supreme Court. In the first day’s hearing, 10 senior lawyers including Senior Advocate Abhishek Manu Singhvi, Senior Advocate Gopal Shankaranarayan presented their arguments.

Solicitor General Tushar Mehta appeared on behalf of the government. After the first day’s hearing, the court passed some interim orders. These include instructions to immediately release the general protesters and keep the details of the PCR call safe.

Which lawyers appeared?

The case that has been filed against the lathicharge and police atrocities on the protesters is a writ petition. This has been presented by lawyer Shailendra Mani Tripathi. Senior Advocate from Tripathi’s side Gopal Shankaranarayan Presented the arguments. Shankaranarayan said that this is not just a matter of Delhi. Excessive force was used against protesters across the country.

Senior advocate in another case Shyam Dewan Also appeared in the Supreme Court. Diwan said that the police threatened to implicate the protesters in a false case. Its videos have also surfaced. It is necessary to investigate this matter seriously. Former judges of the Supreme Court should be given the responsibility of investigating this.

Senior Advocate Shoaib Mallik Said in his argument- The people who came to protest were unarmed. He did not have any weapon. Not a single such video has come.

senior lawyer Shadan Farasat Raised the issue of Bihar. Farasat said that 150 minor children have been kept in custody in Bihar. The children have been in police custody for 48 hours. The government has decided to withdraw the FIR, but the children have not been released yet.

Farasat further said that the Bihar government has published the photographs of the students in the newspapers. Some of the students among them are minors. This should be seen. Apart from these lawyers, senior advocate N Hariharan Also appeared in the court. He said that Delhi High Court has asked to preserve the CCTV footage. On this the Chief Justice said that we are going to do this in the entire country. Advocate Mathews Nedumpara Mentioned the limitations of Article 32.

Tushar Mehta presented arguments on behalf of the government. Mehta said that we need some time to put the facts on record. After this, whatever you order will happen. On behalf of injured policemen S Pattaraju Appeared in court.

4 big things of the court during the hearing

1. The Chief Justice said in the order that all those people who do not have any previous criminal background should be released immediately.

2. The court has ordered to keep all the evidence safe. Apart from this, states have also been asked to appear in the case.

3. During the hearing, the court said that the protesters demonstrated peacefully. In such a situation there was no need for excessive force.

4. Justice Joymalya Bagchi said- There is always a danger of miscreants joining in during the protest.
