The Supreme Court on Tuesday gave a big relief to the protesters involved in the student movements of Cockroach Janata Party. During the hearing on different petitions, the court said that at present the police will not take any action against the students protesting at Jantar Mantar in Delhi or in any state. The top court said that this relief is only for innocent students.
The court ordered the immediate release of innocents and minors. At the same time, cases against people who have old criminal background will not be withdrawn. The bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana gave this decision.
989 protesters from criminal background
According to media reports, out of 2873 protesters identified from CCTV footage, 989 people were found to have criminal history. These people face cases of murder, robbery, robbery, sexual assault, kidnapping and other crimes.
During the hearing, the top court also mentioned the use of pellet gun-electric baton. The court said that an impartial and independent investigation into all allegations related to police excesses is necessary. The court gave an opportunity to the Central Government and Delhi Police to present their side. The bench of CJI Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana said that other states where violence took place can also present their stand.

Students’ protest was peaceful – SC
CJI said that such movements will definitely take place in a democracy. It was a completely peaceful protest by students in which some demands were put forward. This was within constitutional limits. The court said that there should be a thorough and transparent investigation into the incidents of excesses during the protests. The Supreme Court has combined all the cases related to lathi charge. All the cases will be heard together on August 3.
SC said- all evidence should be kept safe
The Supreme Court said in the order that all the evidence should be kept safe so that it can be used in the investigation. The court has said that the police should keep all CCTV footage, drone videos, body-worn camera recordings, wireless records and PCR call records safe. The court said that the digital data of the protesters should also be kept safe.
