Delhi High Court has sought response from Delhi Police on the bail plea of accused Tahir Hussain in the case of alleged major conspiracy of Delhi riots 6 years ago in 2020. The court on Wednesday asked the police to file a reply to Tahir’s petition in which he has sought waiver of the delay of 67 days in filing the appeal against the order of the Karkardooma Court.
The High Court will now hear the next hearing on the bail plea of Tahir Hussain in July. This hearing on the petition will now be held on 16th July instead of 14th. In the case registered under UAPA related to Delhi riots, accused Tahir Hussain has challenged the lower court’s order rejecting bail in the Delhi High Court on January 29.
The ban on framing of charges lifted
Earlier, on Friday last week, the Delhi High Court lifted the stay on framing of charges in the alleged major conspiracy case related to the 2020 riots and allowed the court hearing the case to pass the final order. Justice Neena Bansal Krishna rejected the petition of accused Devangana Kalita and lifted the stay.
Through a petition filed in the court, Kalita had requested to direct the police to provide some videos and WhatsApp chats related to the case. After the verdict was announced, Kalita’s lawyer had made this recommendation to the judge. However, the court accepted a separate plea of Kalita and allowed him to study the documents used in the case under the Unlawful Activities Prevention Act (UAPA).
Case against many people including Tahir
Kalita had filed a petition in the High Court in 2023 claiming that Delhi Police had appointed some persons to record the protests against the Citizenship Amendment Act (CAA) and National Register of Citizens (NRC) in February 2020 and that the footage should be made available to them before the trial court begins arguments on framing of charges.
Along with student activist Kalita, separate FIRs have also been lodged against Natasha Narwal, Jamia Coordination Committee member Safoora Zargar, former Aam Aadmi Party (AAP) councilor Tahir Hussain and several others in connection with the February 2020 riots in North-East Delhi. 53 people were killed and more than 700 people were injured in these riots.
