Relief to Bihar BJP MLA Raju Singh from Delhi High Court, stay on sentence

Giving relief to BJP MLA from Sahebganj, Bihar and former Tourism Minister Raju Kumar Singh, the Delhi High Court has stayed the sentence in the case of death due to firing during New Year celebrations. Delhi High Court said that there is no possibility of final hearing on the appeal in the near future. Raju Kumar Singh has challenged the decision and sentence of the Rouse Avenue Court. The next hearing in the case will be on August 11.

Let us tell you that on the night of 31 December 2018, the MLA Raju Singh New Year celebrations were going on in a farmhouse in Fatehpur Beri in Delhi. During this time, a woman named Archana Gupta had died in the Harsh firing case. The MP-MLA court located at Rouse Avenue in Delhi had convicted Raju Singh and sentenced him to 4 years imprisonment and a fine of Rs 25 lakh.

The court had sentenced four years of imprisonment

While pronouncing the sentence, Special Judge Vishal Gogane had said, “The convict is sentenced to 4 years of simple jail under Section 304 Part II of the IPC and 2 months of jail under the Arms Act.”

The court had also directed that a fine of Rs 25 lakh should be given as compensation to the family of deceased Archana Gupta. The sentence was handed down after Singh was convicted under Section 304 Part II of the Indian Penal Code, which deals with the provisions of the Arms Act, for culpable homicide not amounting to murder and violating the conditions of a license.

A day before the sentencing, Singh had sought release on probation, saying he did not intend to cause the victim’s death and citing his impeccable record as an elected representative.

After the Delhi High Court ordered bail and postponement of sentence, activities intensified in Sahebganj area. Local BJP workers and its supporters celebrated by feeding each other sweets.
