National Herald Case: HC gives relief to Sonia-Rahul Gandhi, gets 3 weeks time to file reply

Delhi High Court has given 3 weeks time to Congress leaders Sonia Gandhi, Rahul Gandhi and others to file their reply on ED’s petition in the money laundering case related to National Herald. During the hearing, the lawyer appearing for the Congress leaders asked for more time to file his reply on the ED petition.

Solicitor General Tushar Mehta, appearing for the ED, argued that the defendants failed to respond despite being given time two months ago. The petition is entirely based on the issue of law, Tushar Mehta said that the trial court’s decision was wrong.

Challenge the lower court order

Actually, ED has challenged the order of Rouse Avenue Court, in which it had refused to take cognizance of the ED charge sheet against these leaders. The ED argues that the trial court erred in holding that a complaint under PMLA cannot proceed without an FIR in a ‘scheduled offence’. Delhi High Court will now hear this case on September 10. Let us tell you that these leaders have to file their reply on the ED’s petition against the rejection of the charge sheet by the lower court in the money laundering case related to National Herald.

The court had issued a notice asking for a reply

On December 22, 2025, the High Court had issued a notice to Sonia Gandhi and Rahul Gandhi and other accused on the matter and sought their response. On December 16, while refusing to take cognizance of the charge sheet, the trial court had said that taking cognizance of the complaint of the investigating agency in this case without an FIR is not acceptable under the law. The court also said that despite receiving the complaint of former Rajya Sabha member Subramanian Swamy and subsequently issuing the summons order in 2014, the CBI had not filed an FIR in the case.
