
A clarification application has been filed regarding the Supreme Court’s decision of 9 November 2019 in the Shri Ram Janmabhoomi case. The application has been filed on behalf of Advocate Prakash Awasthi, in which interpretation and clarification of paragraphs 804 and 805 of the 2019 decision has been sought.
Describing himself as a devotee of Ram, the advocate in his application Shri Ram Janmabhoomi Teerth Kshetra Trust There has been a demand to clarify the constitution, rights, management, ownership of temple properties and powers of the trustees.
The application states that the operation of the trust should be in accordance with the principles of transparency, accountability and professional governance.
Explanation sought from Supreme Court
The applicant has requested the Supreme Court to clarify whether the Trust should function as a public charity or is it a private autonomous trust? In the application, a demand has also been made to give clear instructions regarding the role of Nirmohi Akhara in the management of the trust.
In the application, clarification has also been sought from the Supreme Court on the ownership of the temple land and other properties. In the application, a request has been made to constitute an Independent Expert Committee for the trust and temple administration, which should suggest an administrative structure in accordance with professional and religious traditions.
It has also been demanded in the application that the standards of public accountability should be implemented on the trust and the Supreme Court should also clarify on the applicability of Section 2(h) of the Right to Information Act (RTI).
The applicant declared himself a devotee
The applicant has described himself as Advocate-on-Record of the Supreme Court and a devotee of Lord Shri Ram and has also said that he has visited the temple and donated. It is also mentioned in the application that the petitioners were not parties to the original Ayodhya dispute, hence permission has also been sought to file the present application. A copy of the historic decision of the Supreme Court of 9 November 2019 has also been attached with this application.
Let us tell you that after the incident of alleged theft of offerings in Ram temple came to light, the Uttar Pradesh government has ordered the formation of SIT. Eight accused have been arrested in the case. And SIT investigation is ongoing. Meanwhile, amid the allegations, the resignations of General Secretary Champat Rai and Trustee Anil Mishra have been accepted. At the same time, opposition parties have raised questions on the role of the trust. Congress has demanded an investigation into the entire matter under the supervision of the Supreme Court.
