In the Dhar Bhojshala case of Madhya Pradesh in the Supreme Court on Friday, the state government claimed that the distance of the place where Namaz is offered is only 900 meters. Then the Muslim side clarified that this is air distance. The Supreme Court will now hold the next hearing on July 29 after the state government’s reply to the Muslim side’s petition.
Supreme Court The main reason for this hearing is the dispute that arose between the two parties regarding the alternative place allotted by the administration for Namaz.
Before the bench headed by CJI Surya Kant, senior advocate Huzaifa Ahmadi argued in the court that the alternative place given by the administration for Namaz is about 1.3 kilometers to 2 kilometers away from the road.
Dispute over distance of Namaz place
When SG Tushar Mehta, on behalf of the state government, said that the distance is 900 meters, then Huzaifa said that it is aerial distance. We don’t have helicopters. I just want to point out that every time an attempt is made to disobey your Lordship’s order.
Huzaifa further said that due to such distance the Muslim community has already missed two Friday prayers. SG Mehta, appearing for the Madhya Pradesh government, however, opposed the claim of distance and said that the place is only 900 meters away. However, he has assured the court that he is trying to find a place closer to the Bhojshala premises after talking to the administration.
The bench headed by CJI Surya Kant made it clear that the court order should be followed in letter and spirit.
Next hearing will now be held on July 29
This interim application has been listed on July 29 for review of compliance with the previous order. It is noteworthy that in the hearing on the next date, the Supreme Court can take a final decision on which exact and nearest place should be allotted to the Muslim side for Friday prayers.
Whereas earlier the Supreme Court, while considering the appeals of the Muslim side against the decision of the Madhya Pradesh High Court to declare the disputed Bhojshala complex as the temple of Goddess Saraswati, had on July 14 directed the state government that until the final decision is taken in the matter, some other open space should be provided near the disputed site for Friday prayers from 1 pm to 3 pm.
