
Former all-rounder Yuvraj Singh, who made Team India win the 2007 T20 World Cup and 2011 World Cup, has got a big relief from the Delhi High Court. Delhi High Court will issue an order to remove infringing content against Yuvraj Singh in a case filed against him to protect personal rights. Yuvraj Singh on Wednesday demanded protection of his personality rights in the Delhi High Court. Hearing the case, Justice Jyoti Singh issued a notice and said that she will pass an interim order against Yuvraj Singh directing him to remove the infringing content. The next hearing of this case will be on November 30.
Who was taking advantage of Yuvraj Singh’s name?
During the hearing in Delhi High Court, the lawyer appearing for the cricketer showed a list of infringing links to the court and said that 2 of them have been removed. The list contained links to people who were working for monetary gains. Yuvraj Singh They were using his personality traits to sell goods without his consent. The lawyer said that one of the infringing links was about a post on Reddit, which said that the player used objectionable language against women and had derogatory comments against the cricketer.
The lawyer appearing for Reddit said that the link in question is 2 years old and this action is of defamation and not a case for protection of personality rights. However, Yuvraj Singh’s lawyer said that new comments are being made on the post. The court said that the post is 2 years old and no transcript of it has been given in the case. Right now no takedown instructions will be issued regarding that post and the court will consider it later.
The court said that it will give directions to take down the content that breaks the rules and will first ask the uploaders to remove the content within 48 hours. If the uploader does not remove the content, then the court will ask Yuvraj Singh to contact the concerned intermediary and after that the intermediary will remove it within 36 hours.
What did Delhi High Court say?
Delhi High Court said that the uploaders also have some responsibility. Justice Singh said that she is going to order the removal of the URLs which are part of the case and then Yuvraj Singh can file an application later for future links. If something infringing happens then the court will increase the ban. The court registered the complaint as a suit and issued notice in the interim stay application, directing the intermediaries to file their replies. Compliance affidavit will have to be filed within 3 weeks.
