
Delhi High Court canceled the bail of a female teacher accused in a case related to harassment of a 3-year-old girl studying in a private school in Janakpuri. It is alleged that the teacher took the girl to an isolated and dark room in the basement of the school, where the senior clerk/caretaker sexually assaulted the girl. According to the information, it was only the girl’s second day in school when she had to face this incident. The police had registered a case on the complaint of family members. The girl had also identified both the main accused and her class teacher.
However, the POCSO Special Court had granted bail to both the accused within a week of their arrest. This decision was challenged in the Delhi High Court. The court said that the trial court did not take into account essential factors, such as the seriousness of the alleged crime, the vulnerable condition of the child and the powerful position of the teacher in the school. The court canceled the bail order and directed the accused to surrender before the concerned POCSO court within three days.
The girl identified the accused teacher during video recording
According to the prosecution, the three-year-old victim girl returned home from school on April 30, 2026 and later complained of severe pain in her private part. She reportedly told her mother that an ‘older boy’ from the school took her downstairs and molested her. During investigation, the girl reportedly told that her class teacher took her to the basement, removed her clothes, cleaned blood stains and gave her sweets. Later, during the video recording, the girl identified the accused teacher.
The argument in the case was that the trial court, while adjudicating the bail plea, had effectively given a short trial by questioning the credibility of the girl’s statement and accepting the allegations without any supporting evidence. It further said that the trial court failed to appreciate the seriousness of the allegations, the defendant’s position as the girl’s class teacher and his potential to influence witnesses associated with the school.
The accused teacher got bail after 6 days
Justice Saurabh Banerjee further said that the trial court had erred contrary to settled law in assessing the credibility of the victim’s statement at the bail stage. The High Court also found that the teacher was granted bail just 6 days after his arrest without giving any concrete reason. The High Court also remarked that the accused teacher was associated with the school for 13 years and held an official position, which created the possibility of influencing witnesses or tampering with evidence, especially when the investigation and proceedings were still in the initial stage.
