SIT investigation into the murder of Madhya Pradesh Congress leader’s driver… Big order of the Supreme Court

Supreme Court orders SIT investigation into the murder of Madhya Pradesh Congress leader’s driver. The Supreme Court gave instructions to the DGP of Madhya Pradesh. The Supreme Court directed to constitute a five-member SIT headed by an IPS officer from outside the state cadre, so that the case can be investigated afresh.

On the petition filed by Rajia Ali, wife of the deceased. Supreme Court A bench of CJI Surya Kant and Justices Joymalya Bagchi and V Mohana gave this order. The petition alleged that the ongoing investigation was compromised due to political influence.

The petition claimed that the driver of a Congress assembly election candidate in Madhya Pradesh, her husband, was murdered by people associated with a sitting BJP MLA. It was claimed in the petition that the investigation being conducted by the state police is neither neutral nor objective.

Supreme Court ordered formation of SIT

After hearing the parties, the court directed the DGP of Madhya Pradesh to form a five-member SIT headed by an IPS officer from outside the state cadre, so that the case can be investigated afresh.

Additional Solicitor General SV Raju, appearing for the state, opposed the plea and said the investigation has been conducted impartially, independently and without any discrimination and is nearing completion. However, the Court recorded that during the hearing, it was pointed out that apart from the complainant, there were four eyewitnesses and the investigating agency had not recorded their statements. It also noted that these witnesses had given affidavits to the investigating officers. Therefore, it initiated the formation of a SIT to investigate the matter.

Instructions to form SIT within two days

The court directed the Madhya Pradesh Director General of Police to form a SIT, comprising three IPS officers of the rank of Senior Superintendent of Police and two officers below the rank of Deputy Superintendent of Police.

The bench ordered that the SIT be formed within two days and take over the complete records from the existing investigating agency. The court further directed that the affidavits and statements of the eyewitnesses should be properly recorded and considered before the SIT submits its report in the competent court. The court directed, “The SIT will proceed afresh as per the law. This is new in the sense that the SIT will decide the path (of investigation). The case will be investigated without any impact.”
