RAU’s IAS basement incident: CBI did not find evidence against MCD officials, now eyes on court’s decision

The Central Bureau of Investigation (CBI) has filed its supplementary final report in the court in the much talked about case of death of three civil services aspirants due to water logging in the basement of RAU’s IAS Coaching Center located in Old Rajendra Nagar, Delhi. In this report, CBI has said that during the investigation, no concrete and reliable evidence was found, which could prove that any senior officer of the Municipal Corporation was deliberately negligent or misused his position.

On this basis, the agency has filed a closure report against the senior officers and recommended keeping them out of prosecution. This is the same case which shocked the entire country last year. During heavy rains, the basement of the coaching center was suddenly filled with water, due to which three promising UPSC aspirants died tragically. After this incident, serious questions were raised not only in Delhi but also on the security arrangements of coaching institutes, illegal basement operations and the role of government agencies in the entire country.

After the demonstration, the court handed over the investigation to CBI

After the incident, students demonstrated on a large scale. His allegation was that if safety standards had been followed in time and the administration had taken action in advance, the lives of three youth could have been saved. After this accident, Delhi High Court also took the matter seriously and handed over the investigation from Delhi Police to CBI. The court had also directed the agency to find out whether negligence, corruption or dereliction of duty by any government official led to the accident.

CBI investigated every aspect

CBI interrogated a large number of witnesses during its investigation. Documents related to the coaching centre, MCD files, inspection reports, construction related records, documents related to rain and waterlogging and other technical aspects were studied in detail. The agency also investigated whether municipal corporation officials did not take action despite rules being violated or had any kind of collusion.

No evidence found against MCD officials

According to the investigating agency, after analyzing the available evidence and documents, no such evidence was found from which criminal responsibility of any senior MCD officer could be determined. CBI told the court that there was not enough evidence to file a case of negligence or corruption against any senior officer under the Indian Penal Code. Therefore, instead of filing charge sheet against him, a closure report has been filed.

Case cannot be prosecuted on the basis of suspicion or apprehension

The CBI report does not mean that the accident did not happen or that no one was responsible for it. The agency’s only conclusion is that during the investigation, no legal evidence was found against senior MCD officials on the basis of which they could be made accused. In criminal cases, no officer can be prosecuted merely on the basis of suspicion or apprehension. For this, solid documentary and direct evidence is necessary.

Basements of many coaching centers were sealed

This accident had sparked a wide debate on the security arrangements of coaching institutes running in Delhi. After the incident, basements of many coaching centers in the capital were sealed and standards related to fire safety, building construction rules and disaster management were checked. Notices were issued to many institutions and the local administration also launched a campaign against illegal construction and violation of rules.

Available records and statements of witnesses

The main objective of the CBI investigation was to find out whether there was any serious negligence on the part of government officials which could be considered a criminal offense. The agency says that from the available records and statements of witnesses, there is no conclusion that senior MCD officials willfully violated their duty or acted with any kind of criminal intention.

CBI closure report, court will take decision

Now the court has to take the final decision in this matter. The court can either accept the closure report of CBI, reject it or even give instructions for further investigation if it feels the need. According to law, after the closure report is filed, the final decision is within the jurisdiction of the court.

The reaction of the families of the deceased students and the petitioners on this matter will also be important. If they disagree with the closure report of CBI, they can file a protest petition in the court and raise questions on the investigation. The court will decide further action after hearing both the sides.

RAU’s IAS incident was not just a matter of criminal investigation, but it also gave rise to a serious debate on the shortcomings in the security arrangements, administrative accountability and urban infrastructure of the coaching institutes running in the capital. The death of three talented students has raised the question to what extent safety standards are being ensured for coaching institutes operating in crowded areas.

Big relief to MCD officials

At present, the supplementary final report of CBI has definitely given a big relief to senior MCD officials, because the agency has not found any case of criminal negligence against them. However, the final chapter of this sensitive and discussed matter is yet to be written. Now all eyes are on the court, which after considering the CBI report, will decide what further legal action will be taken in this case.
