Bihar government has become very strict regarding the incidents of paper leaks. The government will impose Goonda Act on those accused of paper leak. In the meeting of the State Council of Ministers held under the chairmanship of Chief Minister Samrat Chaudhary on Monday, the draft of the bill prepared after amending and amending the Bihar Crime Control Act, 2024 has been approved. In this, apart from paper leak, there will be a punishment of six months to one year for committing ten types of crimes. This included cases like use of abusive language, abusing or indecent comments on social media.

What does the imposition of Goonda Act mean in Bihar?

The Bihar Crime Control Act, 1981 was repealed and a new law was implemented in the year 2024. This is effective from 14 March 2024. Now approval has been given to amend some sections of this law. The Goonda Act is generally used against habitual criminals and organized gangs. Under this, the administration can monitor the activities of the accused, take action like District Magistrate and take strict administrative steps. Paper leak is also seen as an organized crime, now in such cases one can resort to Goonda Act along with sections of IPC/BNS.

What is the law of the Centre?

To prevent paper leaks and examination rigging, the Central Government has enacted the Public Examinations (Prevention of Unfair Means) Act, 2024. It is applicable on public exams like UPSC, SSC, NTA, RRB, IBPS. In this, leaking question paper, buying and selling, running solver gang, hacking computer system are crimes.

Which states have the strictest laws?

• The strictest provisions regarding paper leaks are in states like Rajasthan, Uttar Pradesh and Uttarakhand. In some states, there is a provision for this type of crime ranging from 10 years of jail to life imprisonment. Apart from this, fine is also imposed on the people involved in such crimes. Also, an order for attachment of their property may be issued.
• In Rajasthan, there is a provision to sentence people involved in paper leak to life imprisonment. Apart from this, a fine of up to Rs 1 crore can also be collected from the culprit. Apart from this, action can also be taken to confiscate the property of the culprit. This action is taken under the Rajasthan Public Examination Act.
• In Uttar Pradesh too, action is taken against paper leaks, solver gangs and copying mafias under the UP Public Examination Act 2024. A person found guilty in such a case may have to spend his entire life in jail. Also, a fine of up to Rs 1 crore can be imposed.
• In Gujarat, there is a provision of punishment of up to 10 years if found guilty in paper leak. This action is taken under the Gujarat Public Examination Act. Heavy financial penalty can be imposed on the guilty person.
• In Uttarakhand, action is taken under the UK Anti-Cheating Act. There is a provision for life imprisonment and confiscation of property of paper leak mafias. Apart from this, a fine ranging from Rs 10 lakh to Rs 10 crore can be imposed on the culprit.

How strict are the rules on bail of paper leak mafia?

The bail rules for people caught in the paper leak case are very strict. However, in most of the cases, the accused are granted bail by the court on the basis of the seriousness of the crime, the stage of investigation, whether the charge sheet has been filed or not, the role of the accused, possibility of evidence being tampered with, possibility of influencing the witnesses. If there is a possibility of evidence being tampered with, then the court can refuse to grant bail to the accused.

Even in the recent NEET paper leak case, the bail pleas of many accused have been rejected by the courts of Delhi and Patna. During this time, CBI had opposed the bail citing the possibility of tampering of evidence and organized conspiracy.
