
A petition was filed in the Supreme Court challenging the validity of the 84th and 87th Constitutional Amendments, which has been withdrawn by the petitioner himself. These amendments froze the distribution of Lok Sabha seats among the states on the basis of the 1971 census, but allowed the boundaries of parliamentary and assembly constituencies to be redrawn on the basis of the 2001 census.
Justice Joymala Bagchi told the petitioner that you can vote and contest elections from any constituency. The lawyer said that the value of my vote has reduced, now the population has increased. Look at Gurugram, Noida, these used to be villages in the 1970s and very few people lived there then. Now lakhs of people live there. Mohali did not exist then.
‘The value of the vote has not reduced’
Justice Bagchi said that if you look at the federal constitutional structure, the value of vote has not reduced in the context of the state. This question arises only when an unequal method is adopted in the case of Rajya Sabha. CJI Surya Kant said that in some cases legislative intervention may be required, but not of the judiciary.
‘Legislative intervention is needed in some cases’
In the Nishant Khatri vs Union case, the CJI said that legislative intervention may be required in some cases. The lawyer said that the population per MP in Tamil Nadu was 10 lakh. On this the CJI said that it has nothing to do with the amendment.
