
The Delhi High Court on Friday directed Tihar Jail authorities to provide proper medical treatment to Kashmiri separatist leader Yasin Malik, who has been sentenced to life imprisonment in a terror funding case. Justice Neena Bansal Krishna took note of the report of Tihar Jail authorities, which said that Yasin Malik did not appear to be suffering from any life-threatening disease.
The court said that if medical treatment is not available inside the jail according to Yasin Malik’s condition, then he should be given treatment in those hospitals where such facilities are available. Justice Krishna disposed of Malik’s plea filed last year, in which he had sought permission for his treatment at AIIMS or any super specialty hospital in the national capital or Srinagar.
Yasin Malik had claimed serious illness
In fact, Yasin Malik had claimed that he was suffering from serious heart and kidney diseases, along with other diseases and hence, he wanted to be treated at AIIMS or any other super specialty hospital in the country’s capital or Srinagar, Kashmir.
Life sentence was given in 2022
Let us tell you that in May 2022, the trial court had sentenced separatist leader Yasin Malik to life imprisonment in the terror funding case. Yasin had confessed to his crime in this case and did not oppose the charges against him. Later, NIA approached the High Court demanding death penalty for him in this case.
While sentencing Yasin Malik to life imprisonment, the special judge had said that the crime had failed the Supreme Court’s test of rarest of rare cases. The judge had also rejected Yasin Malik’s contention that he followed the Gandhian principle of non-violence and was leading a peaceful non-violent struggle.
Charges were framed under UAPA in 2022
In March 2022, the court had framed charges against Malik and several others in this case under the Unlawful Activities Prevention Act (UAPA). Other accused included Hafiz Muhammad Saeed, Shabbir Ahmed Shah, Hizbul Mujahideen Chief Salahuddin, Rashid Engineer, Zahoor Ahmed Shah Watali, Shahid-ul-Islam, Altaf Ahmed Shah alias Funtoosh, Naeem Khan, Farooq Ahmed Dar alias Bitta Karate. However, the court acquitted three people named Kamran Yusuf, Javed Ahmed Bhatt and Syeda Asiya Firdous Andrabi.
